Expert auction property solicitors in sussex

At Bate & Albon, our team of specialist property auction solicitors offer expert services for both selling and buying a property at auction.

Property auctions are an increasingly popular alternative to the more traditional, sometimes lengthy, process of buying and selling land and property through an estate agent. Sellers benefit from the certainty and speed of auction sales, and buyers are attracted by the lure of potentially being able to secure a good deal.

That said, because auctions usually involve quick turn around times, they can also be riskier than the usual route – especially for the buyer. It is therefore important that both buyers and sellers instruct specialist auction solicitors to act on their behalf, to get a clear understanding of the process involved and to protect their interests.

What should buyers and sellers do before the auction?

Looking to sell your land or property at auction? First things first, you’ll have to instruct a solicitor to put together a Legal Pack, which usually comprises the title deeds, searches, bespoke Special Conditions and other relevant documents.

Ideally, the Legal Pack should be ready for prospective bidders to view two weeks before the auction. The drafting of the Special Conditions is very important because these contain the terms of sale. This includes who the parties are, when the completion date is (often twenty working days), whether the buyer must contribute any extra costs and how the legal title is to be transferred to the buyer.

If you are interested in bidding for a lot at auction it’s important that you ask an experienced solicitor to review the Legal Pack for you. It’s worth noting that buyers are legally bound once the sale is agreed at auction, so it’s essential to get a full view of the obligations, to understand exactly what it is you’re bidding for and what is included in the sale.

Depending on the nature of the lot, the buyer may also wish to instruct a surveyor to inspect the land or property. Our specialist auction property solicitors are on hand to help answer any questions and help you avoid the pitfalls of buying a property at auction.

What must buyers and sellers do after the auction?

If you’ve managed to sell your lot at auction, the next step is for your solicitor to make the necessary arrangements to ensure the buyer’s solicitor has all the information they need to complete on the contract completion date. It can be tricky to tick all the boxes, which is why you need an experienced lawyer to take the reins and ensure a smooth transaction to completion.

Congratulations – you’ve successfully won a bid at auction! Once you’ve paid the contract deposit (usually 10%) it’s time for your solicitor to start the conveyancing process and complete the purchase. Your solicitor will liaise with you, your broker/lender and the seller’s solicitor to ensure that the balance of funds will be available, and that the legal title will be transferred to you.

Our expert property auction solicitors will guide you through this process as quickly and smoothly as possible, making sure any hurdles are handled efficiently and professionally.
