What should buyers and sellers do before the auction?

Looking to sell your land or property at auction? First things first, you’ll have to instruct a solicitor to put together a Legal Pack, which usually comprises the title deeds, searches, bespoke Special Conditions and other relevant documents.

Ideally, the Legal Pack should be ready for prospective bidders to view two weeks before the auction. The drafting of the Special Conditions is very important because these contain the terms of sale. This includes who the parties are, when the completion date is (often twenty working days), whether the buyer must contribute any extra costs and how the legal title is to be transferred to the buyer.

Buying

If you are interested in bidding for a lot at auction it’s important that you ask an experienced solicitor to review the Legal Pack for you. It’s worth noting that buyers are legally bound once the sale is agreed at auction, so it’s essential to get a full view of the obligations, to understand exactly what it is you’re bidding for and what is included in the sale.

What must buyers and sellers do after the auction?

If you’ve managed to sell your lot at auction, the next step is for your solicitor to make the necessary arrangements to ensure the buyer’s solicitor has all the information they need to complete on the contract completion date. It can be tricky to tick all the boxes, which is why you need an experienced lawyer to take the reins and ensure a smooth transaction to completion.

Congratulations – you’ve successfully won a bid at auction! Once you’ve paid the contract deposit (usually 10%) it’s time for your solicitor to start the conveyancing process and complete the purchase. Your solicitor will liaise with you, your broker/lender and the seller’s solicitor to ensure that the balance of funds will be available, and that the legal title will be transferred to you.
